A court hearing this week will address allegations that Sullivan County pressured residents to leave the Adult Care Center despite a restraining order, as family members and facility workers challenge the county’s efforts to close the senior home.
According to court documents, residents were not informed of the restraining order until Sept. 25. The documents also allege residents were pressured to leave the facility and told that if they did not accept the first option presented to them, no other option would be available and they would be discharged to the care of relatives by October.
Michael Sussman, an attorney representing a resident’s family and facility staff, argues that a resolution passed by the Sullivan County Legislature this month to close the facility should be declared void by the court.
Sussman said the county’s handling of the closure was inappropriate and called for the facility to reopen, with preference given to former residents who want to return and workers who want to resume their jobs.
Sullivan County did not respond to a request for comment.
In August, Sullivan County Legislature Chair Nadia Rajsz said the county could not afford to continue operating the Adult Care Center while facing significant revenue losses and rapidly increasing costs.
The dispute comes as the county faces a legal challenge over its decision to close the facility and questions about how residents were notified of the closure and their options for future care.
The hearing is scheduled for Thursday at 10 a.m. in Ulster County Court.
